These Terms of Service ("Terms") govern your access to and use of our website zdwcmedia.com (the "Site"), including any purchases of custom baseballs, footballs, basketballs, soccer balls, jerseys, and related products ("Products"). By accessing our Site or placing an order, you agree to be bound by these Terms. Please read them carefully.
These Terms apply to all visitors, customers, and others who access or use our Site. If you do not agree to all of these Terms, you may not access the Site or purchase our Products.
1. Eligibility
By using this Site, you represent and warrant that you are at least the age of majority in your state, province, or country of residence, or that you have given us your consent to allow any of your minor dependents to use this Site under your supervision. You may not use our Products for any illegal or unauthorized purpose.
2. Account Registration
You may be required to create an account to access certain features of the Site. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information and to update it as necessary. ZDWC Media reserves the right to suspend or terminate accounts that violate these Terms.
3. Products, Customization, and Design Approval
We specialize in custom-made sports gear. All Products listed on our Site are subject to availability and may be modified or discontinued without notice.
Custom Orders: When you place an order for personalized Products, you are responsible for providing accurate and complete design specifications, artwork, logos, text, and color selections. Any errors in your submission may be reproduced in the final Product, and we cannot be held responsible for such errors once the order enters production.
Design Approval: For certain orders, we may provide a digital proof for your review and approval before production begins. Production timelines begin only after you have approved the final proof. Delays in approval will extend the total delivery time.
Color and Display Variations: We make every effort to display the colors and details of our Products accurately. However, actual colors you see will depend on your monitor and screen settings, and we cannot guarantee that the display of any color will be an exact match to the physical Product.
4. Prices and Payment
Unless otherwise stated, all prices are quoted in Euros (EUR). We reserve the right to adjust prices at any time without prior notice, while prices of confirmed orders shall remain unaffected by any price changes.
Full payment is required upon order submission. We accept payments in EUR, GBP, USD and AUD; detailed payment options are set out in our Payment Policy. By submitting your payment details, you warrant that you are authorised to use the selected payment method. We reserve the right to refuse or cancel any order if fraudulent or unauthorised transactions are suspected.
Taxes and shipping fees are excluded from displayed prices and will be shown separately at checkout. International customers shall be solely responsible for all customs duties, import taxes and clearance fees levied by the customs authorities of the destination country or region.
5. Order Acceptance and Cancellation
Receipt of an order confirmation does not constitute our acceptance of your order. ZDWC Media reserves the right to refuse or cancel any order at any time for reasons including but not limited to: product availability, errors in product or pricing information, suspected fraud, or violation of these Terms.
If we cancel an order after payment has been processed, we will issue a full refund to the original payment method. Because our Products are customized, you may only cancel or modify your order before production has commenced. Once production begins, cancellations are not permitted.
6. Shipping and Delivery
Shipping is handled according to the terms set forth in our Shipping Policy, which is incorporated by reference. Delivery dates are estimates only, and we are not liable for delays caused by carriers, customs, or events outside our reasonable control. Title and risk of loss pass to you upon delivery to the carrier.
7. Returns and Refunds
Due to the highly customized nature of our Products, we do not accept general returns, exchanges, or refunds for change of mind, incorrect sizing (unless the error was ours), or subjective dissatisfaction with design choices you approved. We stand behind our craftsmanship:
Defects or Errors: If a Product arrives with a manufacturing defect or if we made an error that differs from your approved proof, please contact us within 7 days of delivery at ZDWCMedia@outlook.com. We will evaluate the issue and, at our discretion, offer a replacement, repair, or refund.
Shipping Damage: Claims for damage during shipping must be reported within 48 hours of delivery, as detailed in our Shipping Policy.
8. Intellectual Property
All content on this Site, including text, graphics, logos, images, software, and the overall design, is the property of ZDWC Media or its content suppliers and is protected by international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or exploit any part of the Site or its content without our express written permission.
User-Submitted Content: By uploading logos, designs, artwork, or any other material ("User Content") for use on custom Products, you represent and warrant that you own all rights to such User Content or that you have obtained all necessary licenses, permissions, and consents to use and to authorize ZDWC Media to reproduce the User Content on the Products. You grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and modify the User Content solely for the purpose of fulfilling your order. We reserve the right to reject any User Content that we believe, in our sole discretion, infringes third-party rights, is unlawful, or is otherwise objectionable.
You agree to indemnify and hold ZDWC Media harmless against any claims, damages, or expenses arising from your unauthorized use of intellectual property in your User Content.
9. Prohibited Uses
You agree not to use the Site or our Products for any unlawful or prohibited purpose, including but not limited to:
- Violating any applicable laws or regulations in your jurisdiction.
- Uploading or transmitting any material that is defamatory, obscene, hateful, or infringing upon the rights of others.
- Attempting to interfere with the security features of the Site, including probing, scanning, or testing the vulnerability of any system or network.
- Using any robot, spider, or other automated means to access the Site for any purpose without our express written permission.
10. Disclaimer of Warranties
Your use of the Site and our Products is at your sole risk. The Site and all Products are provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, either express or implied.
To the fullest extent permitted by applicable law, ZDWC Media disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will operate error-free or without interruption, or that any defects will be corrected.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
11. Limitation of Liability
To the fullest extent permitted by law, ZDWC Media and its directors, employees, partners, agents, suppliers, or affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, arising out of or in connection with (a) your use or inability to use the Site; (b) any conduct or content of any third party on the Site; (c) any Product purchased or obtained through the Site; or (d) unauthorized access, use, or alteration of your transmissions or content.
In no event shall our total aggregate liability to you for all claims arising under these Terms exceed the total amount paid by you to ZDWC Media for the specific Product(s) giving rise to the claim during the twelve (12) months prior to the event.
12. Indemnification
You agree to defend, indemnify, and hold harmless ZDWC Media, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, damages, costs, liabilities, and expenses (including reasonable attorneys' fees) arising out of: (a) your breach of these Terms; (b) your User Content; (c) your violation of any applicable law or the rights of a third party; or (d) your use of the Site or Products.
13. Third-Party Links
The Site may contain links to third-party websites or services that are not owned or controlled by ZDWC Media. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites. You access them at your own risk, and we encourage you to review their terms.
14. Termination
We may terminate or suspend your account and access to the Site immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Site will cease immediately. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
15. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, without giving effect to any principles of conflicts of law. Any dispute arising out of or relating to these Terms, the Site, or your purchase of Products shall first be attempted to be resolved through informal negotiations. If a resolution cannot be reached within thirty (30) days, the dispute shall be submitted to the exclusive jurisdiction of the courts of Hong Kong.
For European Union consumers, you may also be entitled to the protection of the mandatory provisions of the law of your country of residence.
16. Changes to These Terms
We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will make reasonable efforts to notify you by posting a notice on the Site or sending an email to the address associated with your account.
